TAKE NOTICE that the Council of the Corporation of the County of Perth will hold a Public Meeting on April 6, 2017 at 9:00 a.m. in the Council Chambers at the County Court House (1 Huron St., Stratford) to consider an Amendment to the County of Perth Official Plan. The Amendment is being considered pursuant to the provisions of the Ontario Planning Act.
The proposed Official Plan Amendment (OPA) application (which the County has deemed to be complete) affects property in the Township of Perth East described as Lot 29 and Part of Lot 28, Concession 14 (North Easthope Ward). The subject property is owned by Brian & Heather Stever and Shane & Ila Stever. The approximately 64 hectare (158 acres) property contains an existing beef operation with associated structures and a single-detached dwelling. A second single-detached dwelling also exists which is located within an existing woodlot. The applicants state that the second dwelling is surplus to their farming needs and wish to amend the “Agriculture” policies of the County Official Plan to allow the second dwelling to be severed from the balance of the farm property.
Section 126.96.36.199 of the County Official Plan provides criteria which must be met in order to be eligible to sever a surplus farm dwelling. One of such criterions requires that the land on which the surplus farm dwelling is situated and the land to which the consolidated farm operation to which the farm dwelling has become surplus must be located within the County of Perth. The applicants’ consolidated farm property is located outside of the County of Perth.
Further, there is no specific policy which allows for the severance of dwellings which were originally established as supplementary needs to a farm operation.
If the OPA application is approved, it is anticipated that an application to the County’s Land Division Committee for Consent to Sever a Surplus Farm Dwelling will be received, as well as an application for a Zoning By-law Amendment (ZBA) to the Township of Perth East, to implement the County OPA and application for Consent to Sever. Separate Notices of Public Meeting will be sent upon receipt of the above-noted applications if the OPA application is approved.
ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed Official Plan Amendment.
If you wish to be notified of the adoption of the proposed Official Plan Amendment, or of the refusal of a request to amend the Official Plan Amendment, you must make a written request to the Clerk of the County of Perth (Jillene Bellchamber-Glazier), 1 Huron St. Stratford, ON N5A 5S4.
If a person or public body does not make oral submissions at a Public Meeting or make written submissions to the Council of the Corporation of the County of Perth before the by-law is passed, the person or public body is not entitled to appeal the decision of the Council of the Corporation of the County of Perth to the Ontario Municipal Board (OMB).
If a person or public body does not make oral submissions at a Public Meeting or make written submissions to the Council of the Corporation of the County of Perth before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the OMB unless, in the opinion of the Board, there are reasonable grounds to do so.
